Terms and Conditions


This page outlines the terms and conditions which governs the business relation between Free Range Cloud Hosting Inc. and The Client. These terms and Conditions take effect upon first order of services from Free Range Cloud Hosting Inc.


For the remainder of this document, you (the customer) will be referred to as the Client.


Payments


All services are prepaid, that is, you pay in advance for your service. Unless otherwise agreed, payment is to be completed via PayPal or Credit Card.



Cancelation & Refunds


Free Range Cloud Hosting Inc. requires at least 1 business day notification to process any cancellation request. After the cancelation request is processed, all data may be deleted from your VPS/Website. You are responsible for transferring all data off your account before the cancelation period. Any services used for less then 3 days are elligable for a refund. Refunds are only available upon request, by sending an email to billing@freerangecloud.com, and will not be issued automatically. Refunds may be subject to a PayPal processing fee.



Restrictions


Update January, 2022 - All New accounts will have port 25 closed by default due to the potential for abuse. You may open a ticket to request an exemption for valid technical reason, although we may also opt to charge a refundable deposit which will be forfeited if we receive spam complaints. By agreeing to the terms you acknowledge that port 25 being blocked is NOT an acceptable reason to request a refund.

Free Range Cloud Hosting Inc. requires that our services not be used for the sending of unsolicited, bulk email and that no illegal content is distributed. Additionally, Free Range Cloud Hosting Inc. reserves the right to terminate or suspend any user who participates in any activity which results in one or more of our IP ranges being listed by Spamhaus or any other official RBL Listing service.

Additionally, any use of our services to facilitate DDoS or other malicous attacks agaisnt other websites or services is strictly forbidden and is grounds for termination or suspension. While not strictly forbidden, portscanning is generaly considered by victim networks to be abusive. If we receivie abuse reports of unwanted portscanning, we will raise a request for the client to cease such activity. Upon notification of a second infraction, the client will be suspended or terminated with cause.

Finally, a client's services must not be used to facilitate any activity which is considered unlawful in Canada. Violation of these terms may result in immediate account termination. Terminations due to abuse are exempt from our refund policy.


Privacy and Collection of Information


Free Range Cloud Hosting Inc. will collect some imformation (mailing address, email address, telephone number) which will be used for the sole purpose of contacting you about billing or technical support directly related to your product. We will NEVER provide your information to a third party and will never use your information to send you unsolicited offers or marketing material.


Bandwidth Policy


Many of our VPS plans include an amount of allocated bandwidth, something that is standard practice amoung similar VPS providers. In the event that your service reaches it's bandwidth limit your connection speed will be automatically rate limited to 5mbps. We will never fully suspend or disconnect your service because of bandwidth overages. If you find the rate limited speed to be insufficient, you have the option to purchase additional bandwidth. Because bandwidth pricing varies by location, it is best to contact our sales team to discuss pricing options. At the end of the billing month, your bandwidth will reset and your service will return to full speed until your cap is reached again.

Abuse and Fair Use Policy


Some of our plans include unmetered bandwidth subject to our fair use policy. Under this policy you accept that bandwidth is shared and speeds are not guarenteed. Additionally, you are expected to not be utilizing your port to it's full capicity 24x7x365. Under our fair use policy you will never be charged for overages (i.e. your bandwidth is not 'metered'), however, Free Range Cloud Hosting Inc reserves the right to throttle your port speed if you are determined to be abusing our fair-use bandwidth or causing harm to other users or our network infrastructure.
