Terms and Conditions

These terms govern the business relationship between Free Range Cloud Hosting Inc. and the Client. These terms take effect upon the Client’s first order of services from Free Range Cloud Hosting Inc.

Prepaid services Services are paid in advance unless otherwise agreed.
Port 25 closed by default New accounts have outbound port 25 blocked unless an exemption is approved.
No spam or illegal content Abuse, spam, unlawful activity, and DDoS activity may result in suspension or termination.
Fair use applies Unmetered services are subject to fair use and may be throttled if abused.

Overview

This page outlines the terms and conditions which govern the business relation between Free Range Cloud Hosting Inc. and The Client. For the remainder of this document, you, the customer, will be referred to as the Client.

By ordering, renewing, using, or continuing to use any Free Range Cloud Hosting Inc. service, the Client agrees to these terms and accepts responsibility for all activity originating from the Client’s account, services, virtual machines, servers, IP space, credentials, users, scripts, applications, and hosted content.

Payments

All services are prepaid. This means the Client pays in advance for the service period. Unless otherwise agreed, payment is to be completed via PayPal or Credit Card.

Services may be suspended, limited, or terminated for non-payment, failed payment, chargeback, disputed payment, or other billing issue. Reinstatement after suspension may require payment of outstanding invoices, applicable fees, and confirmation that the Client’s billing information is current.

Cancellation & Refunds

Free Range Cloud Hosting Inc. requires at least 1 business day notification to process any cancellation request. After the cancellation request is processed, all data may be deleted from your VPS, website, server, or other service. The Client is responsible for transferring all data off the account before the cancellation period.

Any services used for less than 3 days are eligible for a refund. Refunds are only available upon request by sending an email to billing@freerangecloud.com and will not be issued automatically. Refunds may be subject to a PayPal processing fee.

Refund enforcement: Services suspended or terminated for abuse, unlawful activity, policy violations, spam, DDoS activity, malicious activity, or violation of these terms are exempt from the refund policy.

Restrictions

Free Range Cloud Hosting Inc. requires that services not be used for the sending of unsolicited or bulk email, and that no illegal content is distributed. Free Range Cloud Hosting Inc. reserves the right to terminate or suspend any user who participates in any activity which results in one or more Free Range Cloud IP ranges being listed by Spamhaus or any other official RBL listing service.

Any use of services to facilitate DDoS or other malicious attacks against websites, networks, users, or services is strictly forbidden and is grounds for termination or suspension. While not strictly forbidden, port scanning is generally considered abusive by victim networks. If Free Range Cloud Hosting Inc. receives abuse reports of unwanted port scanning, the Client may be asked to cease such activity. Upon notification of a second infraction, the Client may be suspended or terminated with cause.

A Client’s services must not be used to facilitate any activity which is considered unlawful in Canada. Violation of these terms may result in immediate account termination.

  • No unsolicited bulk email, spam, phishing, credential theft, malware, botnets, or malicious automation.
  • No DDoS activity, DDoS facilitation, reflection attacks, amplification attacks, or intentional network disruption.
  • No hosting, distribution, storage, or transmission of content that is unlawful in Canada.
  • No activity that causes Free Range Cloud Hosting Inc., its network, IP ranges, upstreams, peers, or customers to receive abuse complaints, RBL listings, or operational harm.
  • No attempts to evade abuse handling, hide attribution, bypass rate limits, or continue prohibited activity after notice.

Port 25 Policy

Update January, 2022 — All new accounts will have port 25 closed by default due to the potential for abuse. The Client may open a ticket to request an exemption for a valid technical reason. Free Range Cloud Hosting Inc. may approve or deny port 25 access at its discretion, and may require a refundable deposit which will be forfeited if spam complaints are received.

By agreeing to these terms, the Client acknowledges that port 25 being blocked is not an acceptable reason to request a refund.

Mail policy enforcement: Approval to use port 25 does not permit spam, bulk unsolicited email, phishing, poor list hygiene, compromised mail systems, open relays, or activity that results in complaints or blacklisting. Port 25 access may be revoked at any time if mail abuse is suspected or confirmed.

Enforcement and Abuse Handling

Free Range Cloud Hosting Inc. may investigate any suspected violation of these terms, abuse complaint, network issue, security incident, law enforcement request, upstream provider request, or complaint from a third party. The Client agrees to cooperate promptly with abuse investigations and to provide accurate information when requested.

Depending on severity, Free Range Cloud Hosting Inc. may take enforcement action with or without prior notice. Enforcement action may include filtering traffic, null routing, rate limiting, disabling port access, suspending a service, suspending an account, removing content, terminating service, revoking IP space, refusing new orders, or declining renewal.

  • Immediate action: Severe abuse, DDoS activity, malware, phishing, spam, unlawful content, attacks, or activity threatening network stability may result in immediate suspension or termination.
  • Repeat abuse: Repeated complaints, repeated port scanning reports, repeated spam complaints, or repeated failures to resolve abuse may result in suspension or termination with cause.
  • No refund for abuse: Terminations or suspensions caused by abuse, prohibited activity, unlawful activity, or material breach of these terms are exempt from refunds.
  • Network protection: Free Range Cloud Hosting Inc. may take any reasonable action required to protect its network, upstream providers, peers, IP reputation, other customers, or infrastructure.

Privacy and Collection of Information

Free Range Cloud Hosting Inc. will collect some information, including mailing address, email address, and telephone number, which will be used for the sole purpose of contacting the Client about billing or technical support directly related to the Client’s product.

Free Range Cloud Hosting Inc. will never provide Client information to a third party for marketing purposes and will never use Client information to send unsolicited offers or marketing material.

Free Range Cloud Hosting Inc. may disclose information when required to comply with applicable law, valid legal process, law enforcement request, fraud investigation, abuse investigation, payment dispute, network security incident, or to protect the rights, property, infrastructure, customers, and network of Free Range Cloud Hosting Inc.

Bandwidth Policy

Many VPS plans include an amount of allocated bandwidth, which is standard practice among similar VPS providers. In the event that a service reaches its bandwidth limit, the connection speed will be automatically rate limited to 5mbps. Free Range Cloud Hosting Inc. will never fully suspend or disconnect a service solely because of bandwidth overages.

If the rate limited speed is insufficient, the Client has the option to purchase additional bandwidth. Because bandwidth pricing varies by location, it is best to contact the sales team to discuss pricing options. At the end of the billing month, bandwidth will reset and the service will return to full speed until the cap is reached again.

The Client can view service bandwidth usage any time in the client area.

Abuse and Fair Use Policy

Some plans include unmetered bandwidth subject to the Free Range Cloud Hosting Inc. fair use policy. Under this policy, the Client accepts that bandwidth is shared and speeds are not guaranteed. The Client is expected not to utilize the port to its full capacity 24x7x365.

Under the fair use policy, the Client will never be charged for overages where bandwidth is not metered. However, Free Range Cloud Hosting Inc. reserves the right to throttle port speed if the Client is determined to be abusing fair-use bandwidth or causing harm to other users or network infrastructure. If the Client requires a port with dedicated bandwidth, Free Range Cloud Hosting Inc. can offer this service for an additional fee.

Fair use enforcement: Sustained maximum utilization, disruptive traffic patterns, abusive traffic, excessive scanning, attack traffic, or activity that degrades service for other customers may result in throttling, filtering, suspension, or a request to move to a dedicated bandwidth product.

Client Responsibility

The Client is responsible for maintaining secure passwords, software updates, firewall rules, application security, backups, access controls, and the lawful use of all services. Free Range Cloud Hosting Inc. is not responsible for data loss caused by Client action, software compromise, malware, cancellation, suspension, termination, or failure to maintain backups.

The Client must ensure that any users, customers, contractors, scripts, applications, or third parties using the Client’s service also comply with these terms. Activity originating from the Client’s service may be treated as activity of the Client.
